Arbitration Rules

Arbitration before the CAIP is governed by the CAIP Arbitration Rules in force on the day of receipt of the request for arbitration by the CAIP.

The current CAIP Arbitration Rules are those in force as of 1st June 2024.

Règlement d'arbitrage

The CAIP Arbitration Rules offer the possibility of implementing different arbitration procedures:

Ordinary procedure

The arbitral tribunal is composed, according to the parties’ agreement, of three arbitrators or a sole arbitrator and decides, in principle, in accordance with rules of law .

The time limit for rendering the award is six months.

Available for any dispute.

Expedited procedure

The arbitral tribunal is composed of a sole arbitrator that decides as amiable compositeur and, in principle, solely on the basis solely of the documents submitted by the parties​.

The time limit for rendering the award is four months.

Available for any dispute whose main claim does not exceed 150,000 euros.

Arbitration

All disputes arising out of or in connection with the present contract shall be settled by arbitration under the rules of the CAIP – PARIS INTERNATIONAL ARBITRATION CHAMBER (6, avenue Pierre 1er de Serbie – 75116 Paris ; www.arbitrage.org), which the parties hereby declare to know and accept.

Mediation & Arbitration

All disputes arising out of or in connection with the present contract shall be settled by mediation under the rules of the CAIP – PARIS INTERNATIONAL ARBITRATION CHAMBER (6, avenue Pierre 1er de Serbie – 75116 Paris ; www.arbitrage.org), which the parties hereby declare to know and accept.

If mediation fails, the dispute shall be finally settled by arbitration under the rules of the same chamber, which the parties hereby declare to also know and accept.

Parties may appoint as arbitrator any person from the CAIP roster of arbitrators or any other person they deem fit to act as such:

Commission

The CAIP Commission ensures the application of the CAIP Arbitration Rules and acts, in accordance therewith, whenever called upon, for example, to appoint and confirm arbitrators, rule on challenges to arbitrators, and decide whether to consolidate arbitrations.

As an autonomous and independent body, the Commission carries out its functions in complete independence from the CAIP and its organs.

Costs

The opening fee is set at 3,000 euros (without tax), regardless of the amount in dispute and the procedure implemented.

The arbitration fees, comprising the administrative fees and the arbitrators’ fees, are calculated on the basis of the amount in dispute, which is determined following the guidelines provided in Annex 1 of the CAIP Arbitration Rules, thus ensuring full transparency and predictability.

Each party is responsible for advancing the arbitration fees corresponding to its own claim or counterclaim, which allows for arbitration to take place even against an insolvent or uncooperative party.

The costs of the proceedings are finally fixed by the arbitral tribunal and may thus comprise any other fees and expenses incurred for the arbitration, such as those with experts and counsel.

The unsuccessful party fully bears the costs of the proceeding, unless otherwise decided by the arbitral tribunal.
